An Article 32 is the civilian equivalent of an grand jury or preliminary hearing. An officer will be assigned to hear your case and decide if their is probable cause for your case to proceed to a Court-Martial. They only make a recommendation but this is your opportunity to present your case as to why the case should not proceed and as important, to find out what information the Government has against you and the ability to lock witnesses into their testimony.
Waiting for an issue to resolve on its own rarely happens, so call today for a free consultation. As the Department of Defense plans to decrease the size of the force in the next few years, now is not the time to have any type of permanent blemish on your record. Time is usually of the essence as many of the “issues” listed above are time sensitive – if you miss a deadline, you may have missed your one opportunity to correct a mistake, appeal, or have your case be heard. Whether you decide to fight or not is your decision but at least make an informed decision. The decision you make today could affect your retirement and in some cases your freedom.
